The Flat Tire Buddy is an emergency device to be used for a flat tire only, and should not be used other than for its intended purpose.
We are advising the public that FLAT TIRE BUDDY or its company, FLAT TIRE BUDDY LLC. has a "UTILITY PATENT" AND PROTECTION IN THE USA and IN MANY COUNTRIES. "FLAT TIRE BUDDY" is a "REGISTERED TRADEMARK OF FLAT TIRE BUDDY LLC. In regards to its Patent, we intend to enforce our patent rights legally with damages in a court of law against anyone who should make, manufacture, use to sell, offer for sale, or import this product by any manufacturer. You will be held liable to the fullest extent of the law not only in the USA but INTERNATIONALLY. You will be held liable for all or any of your actions related to this product.

THE REMEDIES PROVIDED HEREIN ARE IN LIEU OF ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SAID WARRANTIES BEING EXPRESSLY DISCLAIMED.
BUYER AGREES THAT ITS SOLE AND EXCLUSIVE REMEDY AGAINST THE SELLER AND/OR MANUFACTURER WILL BE LIMITED TO THE REPAIR AND OR REPLACEMENT OF NONCONFORMING OR DEFECTIVE GOODS, PROVIDED THAT SELLER IS PROMPTLY NOTIFIED IN WRITING OF ANY DEFECT. THIS EXCLUSIVE REMEDY WILL NOT BE DEEMED TO HAVE FAILED OF ITS ESSENTIAL PURPOSE SO LONG AS THE SELLER AND/OR MANUFACTURER IS WILLING TO REPAIR OR REPLACE THE DEFECTIVE PARTS.
SELLER WILL NOT BE LIABLE TO BUYER FOR ANY INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES WHATSOEVER. THE RIGHT TO RECOVER DAMAGES WITHIN THE LIMITATIONS SET FORTH IS BUYER'S EXCLUSIVE ALTERNATIVE REMEDY IF THE LIMITED REMEDY OF REPAIR OR REPLACEMENT FAILS OF ITS ESSENTIAL PURPOSE. THE PARTIES AGREE THAT THIS ALTERNATIVE REMEDY WILL BE ENFORCEABLE EVEN IF THE LIMITED REMEDY OF REPAIR OR REPLACEMENT FAILS OF ITS ESSENTIAL PURPOSE.
